Acceptable Use Policy

Last updated: 2 November 2026

Effective date: October 29, 2026.

This Acceptable Use Policy (the "AUP") governs how you may use Syndai, operated by Eternex, Inc., a Delaware corporation doing business as Syndai ("Eternex," "Syndai," "we," "us," or "our"). It is part of, and incorporated into, our Terms of Service and any Master Services Agreement or order form between us (together, the "Agreement"). Capitalized terms not defined here have the meaning given in the Agreement. If there is a conflict, the Agreement controls, but this AUP adds detail that binds you as if written into it.

Syndai builds and changes websites and web apps from a plain description, and can host them for you. To do that work it sends your prompts, content, and context to third-party AI model providers (each an "AI Provider"): for Syndai's own agents, currently Anthropic, OpenAI, and Google, reached directly or through the OpenRouter routing service; for the AI features of Hosted Projects, the providers OpenRouter routes to (Section 4.2). The companies that host, store, and send for us (for example Cloudflare and our email provider) and the AI Providers hold us responsible for how our customers use their services. This AUP passes those obligations through to you.

Report abuse to abuse@syndai.ai, or with the "Report this app" link that Hosted Projects with sign-in show. Copyright notices and questions about this AUP: legal@syndai.ai.

1. Definitions

  • "Hosted Project" means a website or web app that Syndai hosts for you, whether it is served at a syndai.app address or at a domain you own and connect.
  • "Visitor" means anyone who uses a Hosted Project, including people who sign in to it ("Members").
  • "Visitor Content" means anything a Visitor uploads, posts, saves, or sends through a Hosted Project. As between you and us, Visitor Content is your Customer Content.
  • "Sexually Explicit" means showing or describing sexual intercourse or other sex acts, masturbation, sexual violence or abuse, or the lascivious display of the genitals, anus, or pubic area.
  • "Adult Content" means material that is Sexually Explicit or whose main purpose is sexual arousal, in any form: text, images, audio, or video. Factual sex education, sexual-health or medical information, and non-sexual nudity in art or education are not Adult Content.
  • "Minor" means anyone under 18, or anyone presented as under 18, whether real or fictional.

2. Rules for All Use of the Service

Use the Service lawfully and do not wreck it for anyone else. You must not, and must not allow anyone else (including your Visitors) to:

  • use the Service for any illegal purpose, or to build, deploy, or distribute malware, exploits, or systems designed to cause harm;
  • run phishing or credential-harvesting pages, or impersonate a person, brand, or organization in a way that misleads people;
  • abuse the sandboxes or hosting, including cryptomining, launching attacks or scans against third parties, attempting to escape sandbox isolation, or using compute or storage for workloads unrelated to the purpose of the Service (for example, as a general file host for content unrelated to a Hosted Project);
  • use the Service to send unlawful, deceptive, or unsolicited bulk messages (spam), or to publish or send anything in violation of the terms of the accounts you connect or of applicable anti-spam, marketing, or e-privacy law; you are responsible for having a lawful basis to contact recipients and for compliance with CAN-SPAM, GDPR and e-privacy rules, and CASL, as the sender and, for the personal data of the people you contact, the controller;
  • attempt to access, probe, or extract another customer's data, repositories, connected accounts, prompts, Hosted Projects, or Output, or any non-public part of our systems;
  • circumvent usage limits, credit accounting, scopes, geographic-blocking settings, or other technical restrictions, or share access in a way designed to evade per-seat or usage-based pricing;
  • resell or white-label the Service without a written agreement with us that permits it;
  • reverse engineer the Service, except to the extent applicable law permits notwithstanding this restriction;
  • use the Service to infringe anyone's intellectual property, privacy, publicity, or other rights; or
  • sell or promote goods or services that are illegal where they are offered.

3. Content That Is Never Allowed

The following is prohibited everywhere: in a Hosted Project (including Visitor Content), in Output, in prompts, and through any Syndai feature, with or without an age check, and on any domain.

  1. Child sexual abuse material and the sexualization of Minors. Any content that depicts, describes, or promotes the sexual abuse or sexualization of a Minor, real or fictional, in any form, including text, drawings, animation, and AI-generated material, and any content that grooms, solicits, or sexually exploits a Minor. We have zero tolerance: we remove it, preserve it as the law requires, report it to the National Center for Missing & Exploited Children (NCMEC) and law enforcement, and close the account.
  2. Intimate images shared without consent. Nude or sexual images or video of a real person shared without that person's consent, and threats to share them.
  3. Sexual deepfakes. Sexually Explicit or nude images, video, or audio of a real, identifiable person that were made or altered (for example with AI or a "nudify" tool) without that person's consent, and tools designed to make them.
  4. Adult Content. Adult Content of any kind, including pornography and erotic stories, art, audio, and chat, even when only adults can reach it, it sits behind an age check, or it is on a domain you own.
  5. Sex trafficking and commercial sex. Content that promotes or facilitates sex trafficking or the prostitution of another person, including advertising sexual services for payment.
  6. Violence and hate. Content that threatens or incites violence, promotes terrorism or violent extremism, or attacks people based on a protected characteristic.
  7. Harassment and exposure. Harassment, stalking, or bullying of a person, and publishing someone's private information (such as a home address, government ID, or financial details) without their consent.
  8. Other illegal content. Anything else that is illegal where you offer it or where your Visitors are, including obscene material, content that infringes intellectual property, and unlawful collection of personal data.

4. AI Features

4.1 AI Provider policies. You must comply with the acceptable-use and usage policies of every AI Provider whose models power the Service:

  • Anthropic Usage Policy: https://www.anthropic.com/legal/aup
  • OpenAI Usage Policies: https://openai.com/policies/usage-policies/
  • Google Generative AI Prohibited Use Policy: https://policies.google.com/terms/generative-ai/use-policy
  • for the Syndai AI service (Section 4.2), OpenRouter's terms (https://openrouter.ai/terms) and the policy of whichever provider serves the request (OpenRouter names it for each model: https://openrouter.ai/models)

These policies change over time, and this AUP tracks them as they change. A violation of any AI Provider's policy is a violation of this AUP, whether or not the specific conduct is listed below. In addition, you must not use the Service or its Output to:

  1. Weapons and weaponization. Develop, design, or improve weapons or weaponize systems, including cyber weapons and chemical, biological, nuclear, or radiological weapons.
  2. Child safety. Generate, solicit, or distribute child sexual abuse material, or otherwise exploit, sexualize, or endanger Minors.
  3. System and infrastructure attacks. Attack, disrupt, or gain unauthorized access to critical infrastructure or any computer system, or create or distribute malware, ransomware, phishing, or spam.
  4. Violence, extremism, and hate. Promote or engage in violent extremism, terrorism, harassment, bullying, or hate directed at people based on protected characteristics.
  5. Election and media integrity. Manipulate or interfere with elections, or produce deceptive political content or synthetic media (audio, image, or video of real people or events) without clear disclosure that it is AI-generated.
  6. Personal data, identity, and intimate imagery. Misuse personal or biometric data, impersonate a person or organization, or produce non-consensual intimate or sexual imagery of a real person.
  7. Fraud and deception. Commit fraud, run scams, deceive others, or engage in academic dishonesty or plagiarism.
  8. Competing models. Build, train, fine-tune, or otherwise improve a competing AI model or foundation model using the Service or its Output, including by using Output as training data or benchmarks for that purpose.
  9. Model extraction and resale. Extract, resell, sublicense, or provide raw or standalone access to the underlying AI models outside the terms of the Agreement, or use the Service as a general-purpose proxy for those models.
  10. Undisclosed and unreviewed use. Present AI-generated Output as human-authored where disclosure is required, or rely on Output without meaningful human review in high-risk domains such as medical, legal, financial, employment, housing, insurance, or safety-critical decisions.
  11. Surveillance and unlawful monitoring. Track, monitor, or profile people without a lawful basis and their consent, including facial recognition, emotion recognition, or predictive policing, or use the Service for censorship or unlawful law-enforcement purposes.
  12. Self-harm and psychological harm. Encourage or facilitate suicide or self-harm, or produce content designed to harass, degrade, or psychologically harm a person.
  13. Sexual content. Generate Sexually Explicit content. This is in addition to, and does not narrow, the rules in Section 3.

4.2 The Syndai AI service in Hosted Projects. A Hosted Project can call AI models through Syndai's AI service, which routes each request to an AI Provider through OpenRouter and charges the usage to your credits. You must not use it, or let Visitors use it, to generate anything Section 3 prohibits or anything the AI Provider serving the request prohibits. If Visitors talk to an AI feature, tell them they are interacting with an AI. We may refuse or block requests, cap usage, or switch the service off for a Hosted Project that breaks these rules.

4.3 AI accounts you hold yourself. If your Hosted Project calls an AI provider using credentials from an account you hold directly with that provider, that provider's terms apply between you and it, and Section 3 still applies.

You are responsible for your prompts, your connected repositories, and everything you do with the Output, including its review, testing, and deployment.

5. Your Responsibilities for Hosted Projects and Visitors

You operate your Hosted Projects. Syndai builds and hosts them for you, but you decide what they are for and who uses them, so:

  • You set the rules for your Visitors and enforce them, and you respond to complaints about your Hosted Project and its Visitor Content.
  • You remove unlawful Visitor Content promptly once you know about it, and you do not let Visitors post anything Section 3 prohibits. Only signed-in Members can upload files to a Hosted Project; letting only people you invite sign up keeps tighter control.
  • Intimate images: 48 hours. If Visitors can post images or video, your Hosted Project is likely a "covered platform" under the US TAKE IT DOWN Act. You must give Visitors a clear, plain-language way to ask for removal of an intimate image of them shared without their consent, and remove it, and any known identical copies, as soon as possible and no later than 48 hours after a valid request. We act on such reports sent to us within the same 48 hours (Section 6), but our process does not replace yours.
  • Keep the "Report this app" link. A Hosted Project that lets people sign in or add content shows a "Report this app" link that reaches us. Do not remove or hide it.
  • Privacy. You control your Visitors' personal data as its controller, and we process it for you under our Data Processing Addendum. Keep your Hosted Project's privacy notice accurate; Syndai generates a starter notice for you to review. If your Hosted Project is directed to children, you are responsible for children's privacy laws such as COPPA.

6. Reporting Abuse

Anyone can report a Hosted Project or other use of the Service that breaks this AUP or the law.

  • Where: email abuse@syndai.ai, or use the "Report this app" link where the Hosted Project shows one.
  • What to include: the exact address (URL) of the content; what is wrong with it and, if you believe it is illegal, why; your name and email address; and a statement that you believe the report is accurate and complete. You may leave out your name and email when reporting child sexual abuse material.
  • Intimate images of you, shared without consent: say that the image shows you (or that you are authorized to act for the person shown), that it was shared without consent, give the URL, and sign with your typed full name. We remove valid reports, and known identical copies we host, within 48 hours, and we confirm to you when we have acted.
  • Child sexual abuse material: do not send us the material. Send us the URL, and also report it to NCMEC's CyberTipline at https://report.cybertip.org or 1-800-843-5678.
  • Copyright: send a notice under the Digital Millennium Copyright Act to our designated agent as described in Section 13 of the Terms of Service.
  • Authorities: law enforcement and regulators can reach us at legal@syndai.ai, in English. This is also our point of contact for authorities and users under the EU Digital Services Act.

7. Enforcement

We may investigate suspected violations of this AUP and act on what we find. Depending on the risk, we may remove or disable access to content; take a Hosted Project offline; turn off its Visitor access or its AI service; refuse a build or publication; or throttle, suspend, or terminate your account, as described in Section 8 (Suspension and Termination) of the Terms of Service.

  • When we act without notice. We act immediately, without notice to you first, for child sexual abuse material, intimate images shared without consent, malware or phishing, threats to someone's life or safety, or when a court or authority requires it.
  • Preservation and reporting. We report apparent child sexual abuse material to NCMEC's CyberTipline as US law requires (18 U.S.C. § 2258A) and preserve it and related account information as that law requires. We notify law enforcement when we suspect a crime that threatens someone's life or safety, and we respond to valid legal process.
  • Our reasons. When we restrict your content, Hosted Project, or account, we tell you what we did, which part of this AUP or the law it rests on, the facts we relied on, whether the decision was automated, and how to ask us to review it, unless the law forbids telling you or telling you would hinder an investigation.
  • Review. To ask us to review a decision, reply to our notice or email legal@syndai.ai. A person reviews every request.
  • Repeat violations. We close the accounts of repeat infringers and repeat violators.

You will indemnify us for claims, losses, and costs arising from your violation of this AUP or from your Hosted Projects, including Visitor Content, as set out in the indemnification provisions of the Agreement (Section 12 of the Terms of Service, or the corresponding section of your Master Services Agreement). This includes claims passed through to us by an AI Provider or a hosting or email provider because of your use. Nothing here limits any other remedy available to us or to those providers.

8. Changes

We may update this AUP. For a material change we give at least 30 days' notice by email to your account address, a notice in the portal, or both, before it applies to you. A change required by law, or needed to stop serious harm, may apply sooner.

Questions about this AUP: legal@syndai.ai. Abuse reports: abuse@syndai.ai. Eternex, Inc., 2261 Market Street STE 24499, San Francisco, CA 94114.

9. Send

Send emails the people you choose from mailboxes Syndai sets up for your app. When you use it:

  • No bought or rented lists. Do not upload, import or email a list you bought, rented or scraped elsewhere.
  • Only the people People found or you added. Email only people that Grow › People found for you or that you added yourself.
  • Honour every opt-out. When someone opts out, do not email them again, from Send or anywhere else.
  • Only the countries Send allows. Email only recipients in the countries Send allows: the US; UK companies registered as Ltd, LLP or PLC; Ireland; France; the Netherlands; Sweden; and Finland.
  • No consumer cold email. Send is for business contacts at their work address, never for cold email to consumers.
  • Limits. Send may pause or stop a campaign whose bounces or opt-outs pass its limits.
  • LinkedIn. LinkedIn steps use your own account at your direction. You’re responsible for LinkedIn’s terms.
